Terms of Service

Agreement

These Terms of Service govern your use of Project Radar, a bid intelligence service operated by The FRMWRK Co ("we," "us," or "the Company"). By accessing this website or subscribing to any Project Radar service, you agree to these terms. If you do not agree, do not use the service.

The Service

Project Radar provides curated pre-RFP construction project intelligence, general contractor relationship context, and market timing signals to mission-critical electrical contractors. Delivery is through a weekly curated brief via email. Depending on your subscription tier, delivery may also include periodic review calls and expanded regional or corridor coverage.

The service is informational in nature. Project Radar does not guarantee that any project signal will result in a bid opportunity, awarded contract, or revenue outcome. We do not submit bids on your behalf, represent you to general contractors, or make purchasing commitments on your behalf.

Subscriptions and Billing

Subscriptions are billed monthly. Current pricing is $1,500/month for the Metro Scout plan and $3,000/month for the Regional Specialist plan. Custom pricing applies to embedded intelligence partnerships. Pricing may change with 30 days written notice to active subscribers.

Payment terms and invoicing details are established at the time of subscription. Failure to pay within the agreed terms may result in suspension or termination of service.

Market Exclusivity

Project Radar operates on a one client per metro per trade basis. When you subscribe to coverage for a given metro and trade, no other subscriber of the same trade will receive intelligence for that metro for the duration of your active subscription. Exclusivity takes effect upon receipt of first payment and terminates when your subscription ends or is cancelled.

We reserve the right to define metro boundaries at our sole discretion and will communicate those boundaries clearly at the time of subscription.

Cancellation

Either party may cancel the subscription with 30 days written notice. Notice must be sent to katy@thefrmwrkco.com. No refunds are issued for partial subscription periods already billed. Your exclusivity and service access remain active through the end of the paid period.

Confidentiality of Intelligence

The intelligence contained in your weekly brief is proprietary and provided exclusively for your internal business use. You may not distribute, republish, resell, or share brief contents with third parties outside your organization without our written consent. This restriction survives termination of your subscription.

Accuracy and Limitations

Project Radar uses publicly available data sources, permit records, GC procurement intelligence, and secondary sources to produce confidence-scored signals. We apply a minimum confidence threshold before any signal is included in a client brief. However:

  • Not all signals will result in active bid opportunities
  • Project timelines, GC selections, and scope details may change after a signal is delivered
  • We do not guarantee the completeness of any market coverage area
  • Named GC context is based on available intelligence and may not reflect final procurement decisions

You agree to independently verify any signal before committing significant resources to a pursuit based on intelligence provided by Project Radar.

Intellectual Property

All content, methodologies, signal frameworks, and brief formats produced by Project Radar are the intellectual property of The FRMWRK Co. Nothing in this agreement transfers ownership of any intellectual property to the subscriber.

Limitation of Liability

To the maximum extent permitted by law, The FRMWRK Co's total liability for any claim arising out of or related to Project Radar services will not exceed the amount you paid us in the 30 days preceding the claim. We are not liable for lost profits, lost contracts, missed bid opportunities, or any indirect or consequential damages, even if we were advised of the possibility of such damages.

Governing Law

These terms are governed by the laws of the State of California. Any disputes will be resolved in the courts of Orange County, California.

Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to active subscribers by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
